Should you get paid leave when you have a baby?

A Kent woman, who cannot be named for legal reasons, was denied maternity leave and pay by her employers because she had her baby via a surrogate .

She is taking legal action to secure rights for other parents in her position.

When the woman challenged the Work and Pensions Secretary Iain Duncan Smith she says he told her maternity leave was intended for women recovering from childbirth.

What about men receiving paternity pay? They do not physically give birth to the child but can still be entitled to leave and recompense.
