Terms and Conditions

These terms were amended on 29 October 2018.

The competition is open to all UK residents (including residents of the Channel Islands and the Isle Of Man) aged between 11 and 15 years old on the closing date of Monday 29th October 2018.

The competition is not open to those closely related to ΒιΆΉΤΌΕΔ, ΒιΆΉΤΌΕΔ Group staff members or freelance ΒιΆΉΤΌΕΔ employees, employees or freelancers of Audio Always or of anyone closely related to this competition.

Young Commentator of the Year is a ΒιΆΉΤΌΕΔ Radio 5 Live competition produced by Audio Always Limited. The ΒιΆΉΤΌΕΔ reserves the right to request proof of age as well as a parent’s or guardian’s consent.

Only individual entries are permitted. Individuals are not permitted to submit more than ONE entry. An entrant’s first valid entry will count; any subsequent entries will be disqualified.

Entries will only be considered when submitted via the online mechanism. Only entries in English will be considered. No other method of entry is permitted (this includes email or post).

Entry to the competition is by completing and submitting commentary to match one of the five provided video clips. Clips are approximately 60 seconds in length; the submitted entry should run for the entirety of the clip selected.

Only the part of the entry that runs for the length of the clip selected will be assessed, any excess entry will be disregarded so please ensure your entry does not run over the length of your selected clip.

The entry submission must be the entrant’s own original work and not defame nor breach any copyright or contain anything that could be deemed offensive or inappropriate. The entry should be suitable for a family audience.

Any material that is deemed unsuitable such as to include offensive language, not original (a copy or example of plagiarism), represent or promote criminal or antisocial behaviour, adult themes, and work that could be perceived as an attack on individuals or groups, will be removed from the judging process and disqualified.

Entrants should keep a copy as no entries will be returned. Entries must be suitable to be broadcast by the ΒιΆΉΤΌΕΔ to audiences of all ages. The submission must be accompanied by all the information requested via the online submission process. Any entry with missing information will not be a valid entry and will not progress in the competition.

Entries must be received by the ΒιΆΉΤΌΕΔ by no later than MIDNIGHT on Monday 29 October 2018. Late, incomplete, illegible or inaudible entries will be disqualified. The ΒιΆΉΤΌΕΔ cannot take any responsibility for any technical failure or malfunction, which may result in any entry being delayed, not properly registered or recorded. The ΒιΆΉΤΌΕΔ will not be able to return entries so please keep a copy for your records.

The ΒιΆΉΤΌΕΔ acknowledges that the ownership of any intellectual property rights in the entry remains with the entrants, but that by applying each entrant’s parent or guardian grants the ΒιΆΉΤΌΕΔ the right to use or reproduce, free of charge, their entry or part thereof for the purpose of the competition, including publicising the competition in any and all media in perpetuity throughout the world, fulfilling the prize and any associated competition publicity / coverage on any ΒιΆΉΤΌΕΔ service, channel or online by the ΒιΆΉΤΌΕΔ, ΒιΆΉΤΌΕΔ group companies or its selected third parties. Please note the underlying rights in the clips provided are in no way altered or transferred by this. The ΒιΆΉΤΌΕΔ is granting permission to the entrants to use the clips for the purposes of this competition.

All entries will be judged in the first instance by ΒιΆΉΤΌΕΔ and Audio Always staff. The first round of judging will be completed using the following criteria:

● Enthusiasm - Does the entry show passion for the sport? (25 marks)
● Knowledge - Does the entry demonstrate knowledge of the sport? (25 marks)
● Picture Painting - Does the entry go above and beyond to paint a picture for the listener? (25 marks)
● Delivery - Does the entry fit in with the style and tone of ΒιΆΉΤΌΕΔ 5 live? (25 marks)

The top 15 entries from the first round will be contacted and their entries verified. Verification will occur by Thursday 8th November 2018. If any of the top 15 entries are tied we can accept up to 20 entries for verification prior to the second round. If, after reasonable attempts to make contact the verification has not occurred, the ΒιΆΉΤΌΕΔ reserves the right to disregard that entry. Valid entries will progress to the second round of judging which will be completed by a panel of professional commentators and experts. The panel will use the same criteria, as detailed above, to determine one final winner.

Contact will be made between Audio Always and the parent/guardian of entrants in order to check eligibility and originality of the entry, which may involve speaking to individuals and/ or group members involved in the production of the entry. If an entrant or their parent or guardian is unable to be contacted after reasonable attempts have been made to do so, the ΒιΆΉΤΌΕΔ reserves the right to offer their place to the next best entrant. Unsuccessful entrants will not be contacted.

The Prize is to spend a day with 5 Live at a sporting event. The winner will also get a behind the scenes tour at 5 Live and ΒιΆΉΤΌΕΔ Sport and receive a Young Commentator of the Year trophy.

The ΒιΆΉΤΌΕΔ’s and the judges’ decision is final. No correspondence relating to the competition will be entered into.

Entrants will be expected to take part in post-competition broadcast and online or print publicity for the ΒιΆΉΤΌΕΔ.

The ΒιΆΉΤΌΕΔ reserves the right to cancel the competition or change any of these rules at any stage if deemed necessary in its opinion or if circumstances arise outside of its control. Any such changes will be duly communicated. The ΒιΆΉΤΌΕΔ cannot be held responsible for any unforeseen events relating to the competition having to be cancelled or delayed.

The ticking of the relevant box on the online form shall be taken as the entrant’s parent/guardian having read, understood and accepted these terms and conditions when consenting to the application of the relevant entrant.
To the extent relevant, this competition complies with the ΒιΆΉΤΌΕΔ Code of Conduct for Competitions and Voting .

The ΒιΆΉΤΌΕΔ, Monterosa Ltd, Audio Always Limited, their sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any server, Internet access, system or otherwise which may result in any entry being lost or not properly registered or recorded.

These terms and conditions are governed by the laws of England and Wales.

How the ΒιΆΉΤΌΕΔ handles your data

The ΒιΆΉΤΌΕΔ is committed to keeping your personal data and that of your family secure. The ΒιΆΉΤΌΕΔ is the data controller of your data.

The ΒιΆΉΤΌΕΔ will process the personal information that you provide to us about yourself and your children by submitting your application including entrant name, entrant date of birth, parent/guardian name, parent/guardian email address and parent/guardian phone number. We will only use your data for the purposes of the competition.

We rely on your consent to process your / your child’s personal information. You may withdraw your consent at any time (unless your application is successful) by contacting us using the email address below. If your child is shortlisted, we will follow up with you to ensure that you would still like your child’s application to proceed.

Our online application system is hosted by a third party supplier, Monterosa. We will also share your personal information with Audio Always who have been contracted by the ΒιΆΉΤΌΕΔ to assist with the competition.

If you are unsuccessful, the ΒιΆΉΤΌΕΔ will delete your data after a period of 60 days. We will store the personal information of shortlisted candidates for a period of 6 months. Winners’ personal information will be stored for a period of 2 years for regulatory purposes. The names of the winning and shortlisted entrants will be made public.
