Make a Difference Awards Privacy Notice

Your trust is very important to us. This means the Βι¶ΉΤΌΕΔ is committed to protecting the privacy and security of your personal data. It is important that you read this notice so that you are aware of how and why we are using such personal data. This privacy notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why are we doing this and how can you participate?

The Βι¶ΉΤΌΕΔ is giving you to nominate an individual or a group for the local radio ‘Make a Difference Awards’, which recognise unsung heroes from across the UK.

You can put your nominee(s) forward from one of the following categories:

  • Volunteer
  • Community (The Morning Live Make a Difference Community Award)
  • Fundraiser
  • Carer
  • Great Neighbour
  • Bravery
  • The Green Award
  • The Animal Award

The Βι¶ΉΤΌΕΔ will collect the personal data via an online platform used by the Βι¶ΉΤΌΕΔ.

We ask that you seek permission from your nominee for the nomination itself, letting them know what personal data you’re going to share with us, and to send them a copy of this privacy notice.

There will be four (4) individuals or groups selected to be shortlisted for each category. Those shortlisted will be contacted to take part in a broadcast interview, and invited to attend an award ceremony which will be recorded for broadcast where a winner for each category will be announced.

If your nominee features in a broadcast, this may include the programme being available online and/or on demand, and your contribution may be used again in a future broadcast.

We may use their contribution for promotional purposes on the Βι¶ΉΤΌΕΔ’s social media sites.

What personal data will the Βι¶ΉΤΌΕΔ?

There are two types of personal data: personal data and special category data. Special category data is still personal data, but its processing by the Βι¶ΉΤΌΕΔ requires the Βι¶ΉΤΌΕΔ to follow additional compliance steps.

You must be 18 years or older to nominate someone for the awards.

The Βι¶ΉΤΌΕΔ will collect and process the following personal data about you:

  • Full name
  • Age
  • Telephone number
  • Email address
  • Your relationship to the nominee

The Βι¶ΉΤΌΕΔ will collect and process the following personal data about your nominee:

  • Full name
  • Age
  • Telephone number
  • Email address
  • Nearest city/town/village relating to your nomination

If your nominee is aged under 18, we will also need to confirm parental/guardian permission. In this case we will request the name and telephone number of the parent/guardian.

We may also process special category data about your nominee depending on the content of your submission to us:

  • Health related data
  • Sexual orientation
  • Race or Ethnicity data
  • Religious or philosophical beliefs

Online and social media checks

The Βι¶ΉΤΌΕΔ will carry out background checks on those who are shortlisted, which consist of online and social media screening checks. We will use the personal data processed as part of background checks to verify you meet the eligibility criteria. Information returned as part of a background check may not rule you out of the awards, but non-disclosure of such information which is later discovered may result in your exclusion from the awards.

Who is the Data Controller?

The Βι¶ΉΤΌΕΔ is the “data controller” of your personal data. This means that the Βι¶ΉΤΌΕΔ decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice. As the data controller, the Βι¶ΉΤΌΕΔ has the responsibility to comply, and to demonstrate compliance with, data protection law.

Lawful basis for processing your personal data

The legal basis on which the Βι¶ΉΤΌΕΔ processes your personalβ€―data and special category dataβ€―isβ€―the performance of its public task. The additional processing condition under which the Βι¶ΉΤΌΕΔ processes your special category data is substantial public interest based on statutory and governmental purposes. The Βι¶ΉΤΌΕΔ’s role is to act in the public interest andβ€―toβ€―serve all audiences with content which informs, educates, and entertains.

This is consistent with the Βι¶ΉΤΌΕΔ’s wider public purposes under its Royal Charter which states that, “the Βι¶ΉΤΌΕΔ should reflect the diversity of the United Kingdom both in its output and services. In doing so, the Βι¶ΉΤΌΕΔ should accurately and authentically represent and portray the lives of the people of the United Kingdom today... The Βι¶ΉΤΌΕΔ should bring people together for shared experiences and help contribute to the social cohesion and wellbeing of the United Kingdom.”

We alsoβ€―haveβ€―a legal obligationβ€―to process the personal data of the winnersβ€―in order toβ€―comply with relevant competitionβ€―regulations.β€―β€―

The legal basis on which the Βι¶ΉΤΌΕΔ processes personal data for the purposes of online and social media checks is legitimate interest. It’s Βι¶ΉΤΌΕΔ’s legitimate interest to protect our Awards and the Βι¶ΉΤΌΕΔ’s corporate brand reputation. We have carefully considered the impact on individuals and will not use yourβ€―personal dataβ€―where the impact overrides our interests.β€―

Sharing your personal data

The Βι¶ΉΤΌΕΔ works with our approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of the Βι¶ΉΤΌΕΔ and not independently of the Βι¶ΉΤΌΕΔ.

We may share personal data with a third party where required or permitted by law.

Retaining your personal data

Entrants’ personal data will be held for twelve (12) months after the date of submission.

Contributions that are broadcast and/or published will be retained and archived in perpetuity.

Other personal data from winning entrants and their parents/guardians will be retained for two (2) years for regulatory and compliance purposes.

Your personal data will be stored in the UK and the European Economic Area (EEA).

Your rights and more information

You have rights under data protection law:

  • You can request a copy of the personal data the Βι¶ΉΤΌΕΔ stores about you.
  • You have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you.
  • You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right which may entitle the Βι¶ΉΤΌΕΔ to refuse your request.
  • In certain circumstances you have the right to restrict the processing of your personal data, or to object to the processing of your personal data.
  • You have the right to ask that we transfer the personal data to you or to another organisation, in certain circumstances.
