Newsnight reports on the highly skilled migrants wooed here by the UK government, but now are being refused indefinite leave to remain over tax errors.

Attracting the highly skilled, the brightest and the best has been an ambition for successive UK governments through immigration policy.

It was the premise of the 2008 Labour Government's decision to start the Tier 1 General visa scheme, a points based system that would see highly-skilled people come to the UK to live and work.

The idea was that, after 5 years here, you could apply for indefinite leave to remain. However some were refused after the ΒιΆΉΤΌΕΔ Office and HMRC shared data which showed incorrect self-assessment tax returns.

The courts ruled in 2018 that those refused must have the opportunity to explain these discrepancies, or appeal in court. But some people are still in limbo, and while they wait they and their family are often suffering hardship.

In a statement ΒιΆΉΤΌΕΔ Office minister Kevin Foster told Newsnight: β€œWe are working to resolve these outstanding cases fairly and as quickly as possible. Those awaiting the outcome of their application are not destitute, they have been granted permission to study or work while their cases are reconsidered.”
