Fake or Fortune? is produced by Βι¶ΉΤΌΕΔ Studios for broadcast, use and exploitation by the Βι¶ΉΤΌΕΔ (the Commissioner). We are responsible for handling personal information you provide, including your contribution, in accordance with data protection law.
What information we collect and how we use it?
Βι¶ΉΤΌΕΔ Studios will collect and process your name, contact number, email address and information about your artwork. We will use this information to decide if your contribution will be used in the programme and to contact you if we are interested in finding out any more about your artwork before any footage is broadcast.Βι¶ΉΤΌΕΔ Studios relies on its legitimate interests as a media organisation to process your personal information. We will not process your personal information where your rights override our interests.
Background Checks
If you are shortlisted to be part of the programme, you will be subject to background checks. The nature of these checks will depend on your involvement in the programme. The information obtained be used to assess your suitability to be part of the programme and to inform the measures we put in place as part of our duty of care to our contributors.
Adverse information obtained from a background check may affect your suitability to be part of the programme if, in the opinion of Βι¶ΉΤΌΕΔSPL or the Commissioner, your involvement: (i) could have a negative impact on the reputation of the programme, Βι¶ΉΤΌΕΔSPL and/or Commissioner, (ii) may conflict with our due of care to our contributors, or (iii) because it might not be in your best interests to participate. This could include, for example, information indicating racist, homophobic, misogynistic, or otherwise discriminatory opinions or beliefs, or serious criminal activity or where we may need to consider extra steps to enable responsible participation.
We will use a set of pre-defined keyword terms to search publicly available sources, including internet search engines and public databases/archives. We will also search your publicly available social media profiles from the following social media channels: Facebook, Instagram, X (formerly Twitter), Tik Tok and YouTube. We will begin carrying out searches of these social media profiles from the date of your application.
The lawful basis for the processing of your personal data is our legitimate interest to carry out background searches to determine your suitability to take part in the programme, to protect our reputation and fulfil our obligations to the Commissioner. To the extent we process special category and/or criminal offence data relating to you, our lawful basis is your explicit consent.
You can withdraw your consent at any time prior to the checks being carried out by contacting ally.jenkins1@bbc.com. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. If you do not consent to us carrying out background checks, or withdraw your consent before we have carried out the searches, you will not be able to take part in the programme.
Access to personal data relating to background checks will generally be restricted to relevant members of the production management team and crew. Where relevant in the context of the programme, we may also share your information with the Commissioner, the programme’s professional advisers (e.g. Editorial policy, safety advisers and safeguarding) and if appropriate, external experts.
Where necessary and appropriate, we may share details of the results of these checks with the Commissioner as part of our decision whether to feature you/include your contribution. Once we pass your personal data to the Commissioner, they will become a separate data controller of the personal data provided to them and be responsible for processing and storing it in accordance with data protection law and its privacy policy.
If you are not selected as a contributor due to adverse information obtained through background checks, we will keep a record of this decision.
We may share details from searches that includes personal data with third parties (e.g. law enforcement) where required or permitted by law.
All information obtained through background checks will be deleted 12 months after the programme has been broadcast, except where we are required to retain the data for longer for any lawful purpose.
If you withdraw your consent, we will delete the information found during background checks, but will retain information indicating whether adverse information was found, and (where relevant) if this has prevented you from being selected as a contributor.
Sharing your information
Your personal information will generally be restricted to relevant members of the Fake or Fortune production team and crew, as well as the programme’s presenters and experts, or as otherwise required by law. Where necessary, we may also share information with other Βι¶ΉΤΌΕΔ Studio staff and the commissioning broadcaster, with our professional advisors, and from time to time with other programmes that may have an interest in your contribution.If you would prefer us not to share your data with other programmes please let us know and we will record this.
Retaining your personal information
The information you have provided to us, or that is later collected in connection with the production, will be used by Βι¶ΉΤΌΕΔ Studios for purposes related to the production of this programme. This may include sensitive information that you have provided or will be asked to provide at a later stage, but we will only ask for this type of information if it is relevant in the context of your programme of where necessary for related purposes, such as assessing your fitness to participate in filming.
Βι¶ΉΤΌΕΔ Studios will securely store the information you submit in line with our retention policies and schedules depending on the nature of the data. We do this in case we wish to contact you about your contribution for the programme or where necessary for related purposes, such as assessing your fitness to participate in filming. If we feature your contribution on the programme then your information will be further retained for that purpose.
If we decide not to take your contribution forward your details will be deleted 12 months after broadcast. If you are selected to be part of a programme, Βι¶ΉΤΌΕΔ Studios and the commissioning broadcaster may retain some information relating to your contribution in perpetuity. If we believe that we may want to return to your contribution at a later date, we will retain your information (such as your submission, contact details and any other relevant information in line with our retention schedule, unless you ask us not to.
