I don't know if you are aware of this, but in the United States there is a law called the Native American Graves Protection and Reparation Act which was passed in 1990. It states that all human remains and funerary objects beloning to Native American tribes be returned, so that they can be re-buried. There is still an on-going controversy regarding Native American remains, but as far as I know, all remains must be returned to the tribes in question regardless of the situation.
